InterTrav Corporation is a Tour Operator located in Illinois. These terms and conditions in addition to any other documents we provide (the “Agreement”) describe what you are legally entitled to expect from us when you book your trip through us or the Tour Promotor, in addition to important obligations you make as a customer that effect your legal rights. The terms “we”, “us” and “our”, and “InterTrav” refer to InterTrav Corporation. The term “you” and “traveler” refers to the customer visiting our website, and/or booking a reservation through us or the Tour Promotor. The Tour Promotor is the entity that engaged us to arrange your trip.

YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS

By booking your arrangement with us or the Tour Promotor, you are agreeing to be bound by the terms of this Agreement and any additional terms and conditions of any Supplier that are applicable to your travel arrangements. The Tour Promotor assumes the responsibility of sharing these Terms and Conditions with each traveler, including payment of all amounts when due.  It is the responsibility of each traveler to read our Terms and Conditions in its entirety.

InterTrav is not responsible for any traveler’s unawareness of the Terms and Conditions due to the failure of the Tour Promotor to share this information. If you do not agree with our terms and conditions you should contact us before making a booking.

You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those for whom you make bookings.

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service.

Covid 19 Release of Liability:

You agree that due to uncertainty caused by COVID-19, InterTrav Corporation shall not be liable to any losses howsoever arising. 

Cancellation: We and our suppliers strictly adhere to our cancellation terms, travel protection coverage is strongly advised.

Traveler expressly acknowledges that naturally occurring diseases and viruses (including, but not limited to, the currently widespread COVID-19) may be present and actively occurring in all environments in which your vacation will take place as well as other places where the vacation takes place such as airports, terminals, airplanes, trains, ferries and the like. You acknowledge the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. You acknowledge that COVID-19 has made travel uncertain due to government closures and other travel restrictions. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact (however the exact method of spread remains unknown). You also understand that if you are older or have underlying conditions, you may be more prone to serious infection and death due to COVID-19. As a result of the highly infectious nature of this disease, federal, state, and local governments health agencies recommend social distancing, wearing of PPE (including masks), and have, in many locations, prohibited the congregation of groups of people. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by InterTrav.

By booking a trip at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your trip.

You acknowledge that due to the uncertainty of travel at this time, your trip may be postponed or cancelled or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. You understand that you may become sick before, during, or after the trip and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID-19, InterTrav Corporation has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, InterTrav Corporation shall not be liable to any losses howsoever arising.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS InterTrav Corporation, its members. officers, agents, and/or employees, suppliers, and other tour members (RELEASEES), from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID-19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this INDEMNIFICATION, HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Tour Deposit and Payment: Reservations are made and your booking is confirmed on tour by either registering online or with a Reservation Application and the payment of the required per person deposit. Planning tours takes significant time and costs accrue long before your departure date. Because of this it is vital that you make all payments on time. Payments should be made in accordance with the terms on the tour itinerary. You will receive an invoice for the final payment. For bookings made within 90 days of departure date, full payment is due at time of reservation.

If we do not receive any payment due in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall, in that event only, return any deposit received. Reservations are non-transferrable.

Reservations may be made by check or major credit card. While we do accept major credit cards, you must provide to us a signed charge authorization agreement or click authorization for every transaction for your trip. Your authorization is a binding agreement for us to charge your card and as such you waive any right to chargeback in the case of cancellation for any cause whatever, including a Force Majeure event, as defined herein, and agree to refund policies and procedures as outlined in these Terms and Conditions. Should a Travel Advisor book any tour, vacation, hotel, or rail ticket, which is then the subject of a chargeback, InterTrav will dispute the chargeback, but should the dispute fail, the Travel Advisor shall become liable to reimburse InterTrav the amount of the chargeback.

Tour Pricing: The tour price is based on a minimum number of travelers, and includes planning, handling and operational charges and is quoted on the current rate of exchange, tariff rates and airfares in effect at the time of printing the tour brochure. In the event of a marked increase or decrease in foreign currency or in tariff rates, the cost is subject to revision.

Tour prices do increase every year and it is possible that increases could occur after the printing of the brochure in advance of your tour’s departure.  InterTrav Corporation will do everything possible to avoid an increase in the tour cost. However, should increases occur in airfares, hotel prices, and/or coach transportation costs, they will be added to the tour cost and travelers will be notified accordingly. Should an increase in price occur, notifications will be sent to travelers in writing no later than 30 days prior to departure.

Booking Documents: Travelers are required to immediately review all aspects of their booking to verify (but not limited to): traveler names, mailing address, email address, telephone number, and date of birth. Please notify us immediately if any omissions and/or corrections are needed regarding the booking details. Traveler(s) voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. Traveler(s) is required to provide accurate legal names identical to the identification (passport or government issued photo ID) that will be used during travel.

What’s Included in Your Tour?

Airfare: Airfare is only included as detailed on your itinerary. Please note that your agreement regarding airfare is subject to the terms and conditions of the air carrier. You should become familiar with those terms, including the terms of cancellation which will apply to your booking. If Airfare is not included in your itinerary you must not purchase airfare until your booking is confirmed.

Airline Ticketing/Seating: For ticketing InterTrav requires a copy of the photo page of your passport or government issued photo ID. If a ticket requires a name change because of incorrect information supplied to our office, the traveler is responsible for any applicable charges. Group air reservations are handled differently than individual reservations, and each airline has their own guidelines and restrictions on seat assignments and upgrades. If you wish to have your seat pre-assigned, or would like to upgrade, you must e-mail your request to travel@intertravcorp.com. The cost for pre-assigned and/or upgraded seats varies, as does the time frame we are able to make the request with the airline. Every effort is made to ensure requests are honored; however the responsibility is with the airline and beyond the control of InterTrav Corporation.

 

Accommodations: Accommodations are provided as detailed in the final itinerary. Special requests such as single rooms, lower floors, connecting rooms and smoking preference, must be made at the time of booking. While we will make reasonable efforts to communicate your requests to the supplier, such requests are not guaranteed and are at the discretion of the supplier. There may be additional charges for such requests which will be solely the expense of the guest making the request.

Travelers should be aware that hotel room sizes, standards and facilities can vary regionally and are often different from standards in the United States. This can include difference in bed sizes and room sizes, bathroom amenities, amenities such as air-conditioning and compliance with other standards such as ADA and wheelchair accessibility. One of the joys of international travel is experiencing different cultures and ways of life so we hope that you will accept these differences with grace and a sense of adventure.

InterTrav reserves the right, if necessary, to substitute other similar hotels for hotels listed on your final itinerary. Such substitutions may be made at any time and without prior notice. We cannot be held responsible for hotel over-bookings; should such occur, we will undertake to find similar accommodations in the same area. Such substitutions are at InterTrav’s sole discretion and no refunds will be offered for changes in accommodations.

While we exercise due diligence in the selection of our partners, hotel and other accommodation profiles are based on information provided to us by the supplier. This includes images and descriptions of the properties and rooms. Additionally, travelers should be aware that star ratings or similar systems are based on country classifications and therefore can differ. While InterTrav does its best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities, or images.

Transfers: InterTrav is pleased to offer transfers in accordance with your individual itinerary. You must be on time for all transfers. There will be no refund for missed or unused transfers. If your airfare was not included in the tour, you must provide us your flight information no less than 30 days prior to departure to ensure transfers will be available. If at any time your flight plans change, you must notify us immediately. Failure to do so may result in missing these services and no refund shall be due for missed arrival transfers resulting from missing or outdated flight information.

Meals: Meals are as indicated in the itineraries. Meals do not normally include beverages except for coffee or tea with breakfasts. Special diets should be requested at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, InterTrav and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise the hotels and other suppliers of your request but we cannot guarantee their availability.

Guided Transportation: Transportation for guided tours is provided by private, air-conditioned motorcoach or other transportation, as required by the final itinerary. Group Leaders and/or Tour Escorts are responsible for determining seating arrangements on-board and may rotate seating for the enjoyment of all travelers. For the comfort of all travelers, alcohol consumption is typically restricted, and smoking is strictly prohibited on-board. Failure to follow the Group Leaders or Tour Escorts instructions may result in dismissal from the tour. InterTrav will not be responsible to provide any refund in such case nor will we be liable for additional expenses you may incur as a result of dismissal.

Sightseeing and Events: Sightseeing tours and events are included as provided in the individual itineraries. Sightseeing tours are designed to accommodate individuals as well as groups. It is essential that you keep in mind that tour times are set to accommodate climate, crowd size and best viewing options for our groups. As a courtesy to others in the tour, it is mandatory that you be on time for all scheduled experiences, and failure to arrive will be considered a no-show for which no refunds will be available.

Changes to Itineraries: InterTrav reserves the right to make changes to its published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services.

While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, acts of God, or any other reason. InterTrav reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No tours will be cancelled due to renovations, although InterTrav may choose to amend itineraries for such sites. These changes will not be considered material changes and will not be considered cause for cancellation by the guest.

If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

What’s Not Included: Any items and matters not referred to in your itinerary are not included in the tour price. This can include, but is not limited to items such as airfare, checked and/or excess baggage; passport and visa fees; trip protection and/or insurances of all kinds; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; optional tours; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the tour whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.

Non-Operation of Group Tours: All tours are based on a minimum number of participants. InterTrav makes every effort to ensure that tours meet their minimum requirements. However, if the tour drops below the minimum number of participants cancellation of the tour may occur at the sole discretion of InterTrav. In such case, guests will be advised at least 45 days prior to departure. InterTrav reserves the right to change the departure date. We may offer alternative tour dates or other travel arrangements. You may choose to accept these arrangements or to cancel your booking, in which case a full refund will be provided. Any air cancellation will be in accordance with the terms of the carrier and InterTrav will not be liable for the carrier’s refusal to make any refund whatsoever. In such case InterTrav will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance or any other purchases made by the guest in anticipation of the tour.

Changes by Traveler: This is a package tour in which special group airfares and land tour costs have been combined in the most advantageous way. Should you wish to make any deviation from the package tour by changing your departure and/or return dates, the advantages of the package tour price may be eliminated, and additional charges will be assessed. There will be a service charge of $100 per person for altering the airline itinerary, plus any additional charges assessed by the airlines.

Cancellation: As described above, InterTrav is required to pay all suppliers well in advance of your tour date. This includes but is not limited to flights, transportation, hotel accommodations, admission tickets, meals, show tickets, etc. All suppliers have their own cancellation policies, which apply to your booking. Should a cancellation become necessary, please inform InterTrav immediately in writing and request a written confirmation of your cancellation. IMPORTANT: Cancellations will not be accepted by telephone and must be sent in writing to: InterTrav Corporation, 203 State Avenue, St. Charles, Illinois 60174, or emailed to travel@intertravcorp.com

Upon, receipt, InterTrav will follow industry procedures for any applicable refunds as outlined in the supplier’s terms and subject to their review. If you are entitled to a refund, please note that the supplier is responsible for this refund, not InterTrav. Suppliers may choose to provide a travel voucher or credit in lieu of refund. We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.

Unless otherwise specified on the tour brochure, in addition to the terms of our suppliers, return of monies paid to InterTrav will be refundable for individual cancellations per the following:

  • If after making your initial deposit you find it necessary to cancel from the tour for any reason, there is a cancellation charge equal to the per person deposit up to 90 days prior to departure.
  • For cancellation between 89 and 60 days prior to departure, there is a cancellation charge equal to 50% of the tour cost.
  • For cancellation within 59 days of departure, the cancellation charge is 100% of the tour cost.

At all times, cancellation of air travel is governed by the terms of the air carrier.

Because we and our suppliers strictly adhere to our cancellation terms, travel protection coverage is strongly advised.

Cancellation by InterTrav: We reserve the right to cancel or reschedule any departure for any reason. If we cancel, except in the case of a force majeure event, we will offer alternate arrangements. We may at our sole discretion offer travel vouchers or refunds in accordance with the cancellation schedule above. Traveler is responsible for any additional costs for air tickets or other travel arrangements not made by us.

Force Majeure: InterTrav assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other similar unforeseen circumstances or any other factors unforeseen by InterTrav that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, InterTrav shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind including liability to make any refund.

Travel Protection Coverage: InterTrav strongly encourage all guests to purchase a Travel Protection Plan including additional Cancel for Any Reason coverage. Such plan at a minimum should cover Trip Cancellation or Interruption, Cancel for Any Reason, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Purchasing coverage may be limited by time constraints so it is imperative that you purchase protection as soon as possible after booking.

InterTrav is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel protection plans. InterTrav cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.

Destinations: Travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each traveler’s risk tolerance is different, InterTrav is not in a position to advise or recommend whether travel to any particular place at any particular time should take place. It is recommended that the guest should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov). In addition, you should consult with government websites to ensure that you are in compliance with all requirements for admittance into that country as well as understanding local laws that govern travel within a country, such as tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, InterTrav will not be liable for damages or losses that result from travel to such destinations.

Passports and Visas: A valid passport is required for United States citizens for international travel. Passports must be up to date, generally with an expiry at least 6 months after the trip return date. Many countries also require that your passport have at least two completely blank pages. For up to date visa requirements US citizens should visit www.travel.state.gov

Citizens of other countries require a valid passport and may require additional documents. Such persons should contact consulates of countries to be visited and obtain proper documents before departure. The possession of required and valid passport and visas is the sole responsibility of the traveler. InterTrav assumes no liability for lack of proper documents.

It is essential that you see your health care provider before booking your trip and before traveling to make sure that you have taken all necessary health precautions. For up to date medical advice we strongly recommend that you visit the Centers for Disease Control and Prevention (CDC) travelers’ health page: www.cdc.gov/travel or for non-US citizens, your country’s equivalent.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. InterTrav cannot be held responsible for denied entry if a Traveler is unable to provide details to authorities of insurance or denial of entry for any reason.

It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc., that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/exit fees which will be collected at the airports upon entry/departure by local government authorities. Please note that entry to any country may be refused even if the required information and travel documents are complete.

Any failure of a participant to have proper passport and/or visas will likely result in the participant not being able to leave the country or enter a destination and no refund will be available in any such case and InterTrav will have no liability in such case.

Disinsection: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transportation’s Disinfection Information page on their website at the time of booking for further information. https://airconsumer.dot.gov/spray.htm.

Responsibility: INTERTRAV CORPORATION, 203 State Avenue, St. Charles, Illinois 60174, and its employees, shareholders, agents, and representatives (InterTrav) uses third party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this tour. InterTrav is an independent contractor and is not an employee, agent, or representative of any of these suppliers. InterTrav does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. InterTrav is not affiliated with any other tour operator. All suppliers are independent contractors, and are not agents or employees or representatives of InterTrav. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all customers agree that neither InterTrav, nor its employees, agents, or representatives are or shall be responsible or become liable for any delay incurred or change in schedule by any person in connection with any means of transportation; nor for any loss, damage or injury to person or property or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of InterTrav. InterTrav assumes no responsibility or liability for any loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; InterTrav assumes no responsibility or liability for personal property; and InterTrav shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. InterTrav accepts no responsibility for lost or stolen items. InterTrav reserves the right to refuse any participant or potential participant at its sole discretion. No refund will be made for voluntary absence from the tour unless arrangements are made at the time of booking.

Additional Risks: Additional risks and dangers may arise including, but not limited to, hazards of travel by aircraft, automobile, motor coach, train and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, risks associated with food, water, plants, insects and differing animal regulation, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with InterTrav to participate in such trips and activities you agree you will not make a claim against InterTrav, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release InterTrav, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives, and assigns.

Where the traveler occupies a motor coach seat fitted with a safety belt, neither InterTrav nor the Operator nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Operator or its agents or affiliated entities are liable in other circumstances.

Your Conduct and Indemnification: Each traveler is expected to act responsibly and adhere to all behavior guidelines established by InterTrav and our local suppliers. We and our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt the general well-being of the trip itself. In any such case, there will be no refund.

When you book with us or the Tour Promotor, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. InterTrav is not responsible for any costs incurred concerning a traveler removed from a tour. Travelers agree not to hold InterTrav or any of its related entities liable for any actions taken under this clause.

Pre-existing Medical Conditions/Persons with Disabilities: The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our tours.

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your trip, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. InterTrav will make reasonable efforts to accommodate requests, but cannot be responsible if ADA accommodations are not available. Any accommodations provided will be at the sole expense of the guest requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.

InterTrav, Group Leaders, Tour Escorts, and suppliers are, unfortunately, unable to offer additional assistance to passengers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify InterTrav at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

Health: For the safety or our guests, InterTrav reserves the right to request health information prior to travel and to exclude any participants it deems unfit for travel at its sole discretion.

Photographic/Video Likeness: Traveler hereby gives consent to InterTrav to publish any photographs and/or videos of the trip or Traveler in printed or electronic media without obtaining further consent and without compensation. Each Traveler releases InterTrav and its representatives from any liability in connection with any use of such photographs and/or video.

Severability: If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

Jurisdiction/Choice of Law/Venue: This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Illinois, exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Illinois. You agree that you will only bring claims against InterTrav in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. InterTrav shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a tour means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against InterTrav unless you have first provided a written notice of claim to InterTrav within 30 days after the tour or cancellation of the tour.
